Michael Smith (55) Sentenced to 20 years in State Prison for Stalking

On Tuesday, September 18, 2018, Michael Sidney Smith (DOB 12/26/1967) plead guilty to felony Stalking with a Prior Conviction for Criminal Threats and to an additional charge of making Criminal Threats. He was sentenced to twenty years in State prison.
On September 18, 2018, Michael Sidney Smith (DOB 12/26/1967) pleaded guilty to violating Penal Code section 646.9(c), Stalking with a Prior Conviction for Criminal Threats, and Penal Code section 422, making Criminal Threats, both felonies. Smith also admitted suffering a prior serious felony conviction under California Three Strikes Law, and was sentenced to twenty years in State prison.
During the Spring and Summer of 2016, Mr. Smith engaged in a series of acts constituting stalking, including following the victim in violation of a criminal protective order and using social media to threaten the victim’s life. At the time of these activities Smith was on parole from state prison for a previous domestic violence conviction involving the same victim.
"The District Attorney’s Office takes domestic violence prosecutions very seriously. Prosecuting serious crimes such as stalking holds dangerous offenders accountable. We are hopeful that the significant prison sentence imposed in this case will provide the survivor time and space to heal," said Deputy District Attorney Danielle Wheeler, who prosecuted the case.
The case was investigated by the City of San Luis Obispo Police Department, with the assistance of the San Luis Obispo County District Attorney’s Bureau of Investigation and prosecuted by Deputy District Attorney Danielle Wheeler.
