Probation Statement of Loss


The San Luis Obispo County Probation Department’s Victim Restoration Unit is in charge of enforcing the orders of the Courts through the collection of restitution and fines.  It is vital and necessary to uphold the orders of the court and make the individuals who have committed crimes financially accountable in terms of fines, fees, and restitution and, to reimburse the County for expenses incurred as a result of criminal activity.

It is the intention of the Court that victims be made whole for any losses incurred. Representatives of the Victim Restoration Unit can assist victims in submitting claims for restitution to be assigned to those defendants granted probation.

What is the process?

Probation Statement of Loss

A San Luis Obispo County Probation Officer will perform an investigation with the Defendant and prepare a pre-sentencing report for the Court. The victim will then receive a Probation Statement of Loss form which will allow them to identify and document any losses that are a direct result of the crime committed against them. Upon receiving the Statement of Loss form the victim has fifteen (15) days to complete the form in order to claim restitution. The sentencing Judge will then review the statement and decide the terms of the restitution request. 

Who can use this service?

Victims of a crime who have suffered some type of loss may use this service. Examples of loss may include:

  • Lost wages
  • Crime-related losses
  • Damaged or stolen property
  • Acquired medical expenses

Is there a charge for this service?

This service is provided free of charge.

When and where is this service offered?

This service is available throughout the year during regular business hours except during scheduled holidays.
