Workers' Compensation Fraud

Fraudulent Workers' Compensation claims drive up the cost of workers' compensation insurance for local businesses.  Workers' compensation fraud can take many forms including; employee feigned or exaggerated injury, employee claims for non-work related injuries, employer premium fraud by not claiming employees or reduction of work hours on paper, and medical billing for unnecessary services or services not actually provided. In many instances workers' compensation fraud is a felony punishable by up to five years confinement and a fine of up to $150,000 or double the amount of fraud, whichever is greater.  Prohibited conduct and associated penalties can be found in California Insurance Code section 1871.4.
