Accessory Dwelling Unit Ordinance (Secondary Dwellings)
On May 25, 2017, the San Luis Obispo County Board of Supervisors approved Phase I of the Accessory Dwelling Unit Ordinance. The Phase I amendment, which brought the County’s Land Use Ordinance into compliance with California State Code Section 65852.2 regarding Accessory Dwelling Units, eliminated County requirements for road surfacing and owner-occupancy for secondary dwellings.

The Board of Supervisors has directed staff to initiate Phase II of an Accessory Dwelling Unit Ordinance to further incentive and remove unnecessary barriers to their development. As part of this effort, the County will review existing restrictions and limitations on secondary dwellings throughout the unincorporated areas of the County.
On September 12, 2019, the Planning Commission recommended approval of the amendments to the Board of Supervisors with the following changes:
- Prohibiting ADUs in the Very High Fire Hazard Severity Zone countywide
- Allowing one ADU on Agriculture and Rural Lands parcels in addition to the two primary dwellings allowed
- Adding language that an ADU is considered Residential Accessory Use for the purpose of determining land use limitations in Article 9 (Planning Area Standards) and Article 10 (Community Planning Standards)
- Allowing ADUs in front of the primary residence as long as it still meets the setback requirements
Planning and Building Staff is anticipating that the ADU Ordinance will be heard by the Board of Supervisors in early 2020.
