Board Adopts Phase II Cannabis Ordinance Amendments


The Board of Supervisors adopted the Phase II Cannabis Activities Ordinance Amendments on June 4, 2019 as recommended by the Planning Commission. Further direction was given to Planning and Building staff to continue preparations of Phase III ordinance amendments to include:

1) Disallowing outdoor grows; 2) stricter enforcement; 3) Increasing the location standard from sensitive receptors (to include residences); 4) Disallowing in-lieu fees to offset water usage; 5) No revolving door on expired or revoked land use permits; 6) Consideration of small-scale infusion on Ag Land; 7) Requiring all indoor operations to be fully enclosed; 8) Ancillary nursery to be encompassed within the allowable canopy area (maximum of 25% of total canopy area); and 9) Discussion of the process for amending Title 19 to allow drying in hoop houses. 

Staff anticipates to return to the Planning Commission in Fall/Winter of 2019 with draft amendments.  The Coastal Zone Land Use Ordinance will be forwarded to the California Coastal Commission for formal consideration following consideration of Phase III ordinance amendments.
