Expired Lease or Rental Agreement
- My lease has expired. What are my options?
- If a lease has expired and a new lease has not been signed then the homeowner automatically has a month-to-month arrangement (with rent control) and keeps the same rental rate as the expired lease (California Civil Code 798.17(a)(1) and the County’s Title 25 25.06.010(a)(2)).
- No lease or rental agreement is allowed to have an automatic renewal clause (California Civil Code 798.17(g) and 798.18(c)).
- A written agreement is required between the park owner and the home owner (per Civil Code 798.75) and shall contain the items described in Civil Code 798.15.
- Pursuant to Civil Code 798.17 and 798.18, a homeowner with an expired or expiring lease or rental agreement shall be given a choice between a long-term lease or a short-term lease (such as a month-to-month lease with rent control).
- My rental agreement expired years ago and there is no new one. The mobile home park manager says I must sign a long-term lease (without rent control). Must I sign it?
- No. The park manager must offer you a choice between and short-term or long-term rental agreement with the same rental rate as the expired lease.
