Jessica Allred Found Guilty of Vehicular Manslaughter While Intoxicated

Jessica Lea Allred (DOB 11/09/1992) was found guilty by a San Luis Obispo County Jury today. The defendant was accused of killing Denise Lyn Fox while driving intoxicated from Pozo towards Santa Margarita on April 30, 2016.


Today, a San Luis Obispo County jury found Jessica Lea Allred (DOB 11/09/1992) guilty of three felonies stemming from an automobile collision that resulted in the death of Denise Lyn Fox on April 30, 2016. 

  
On July 5, 2018, a San Luis Obispo County jury found defendant Jessica Lea Allred (25) guilty of Vehicular Manslaughter While Intoxicated, in violation of Penal Code 191.5(b), and Driving under the Influence of Alcohol Causing Injury, in violation of Vehicle Code sections 23153(a) and (b), all felonies.  The jury also found that Ms. Allred personally inflicted great bodily injury on Ms. Fox.  The verdict came after an 8-day trial, and half-day of deliberation.


On April 30, 2016, at approximately 6:00 p.m. Ms. Allred drove on State Route 58 from Pozo towards San Luis Obispo after leaving the Pozo Stampede.  Witnesses described her driving in an unsafe manner.  Near Santa Margarita, Ms. Allred’s white Saturn crossed the double yellow lines into on-coming traffic, colliding with the car of Denise Lyn Fox.  Ms. Fox succumbed to her injuries on the scene.  Ms. Allred was also injured in the collision and taken to Sierra Vista Hospital.  The California Highway Patrol responded and determined, through the administration of field sobriety exercises, that Ms. Allred was under the influence of alcohol.  A forensic alcohol test revealed Ms. Allred had a blood alcohol level of .17%, more than twice the legal limit of .08%.

    
“This is a tragic, yet very real, example of what can occur when an individual drives under the influence of alcohol.  The District Attorney’s Office stands shoulder to shoulder with the California Highway Patrol and other law enforcement in aggressively prosecuting these criminal offenses.  We are hopeful that this conviction will provide some level of justice for the family and friends of Ms. Fox, and will serve as a deterrent for those who would otherwise engage in similar conduct,” said District Attorney Dan Dow.


The sentencing for Ms. Allred is scheduled for July 30, 2018, in Department 7 of the San Luis Obispo County Superior Court, the Honorable Judge Craig van Rooyen presiding.  Ms. Allred was remanded to the custody of the San Luis Obispo County Sheriff's Office pending sentencing.  The case was investigated by the Templeton Area Division of the California Highway Patrol and the San Luis Obispo County Sheriff’s Office, and prosecuted by Deputy District Attorney Chase Martin.
